Terms of Service

These Terms of Service ("Terms") govern your access to and use of Happy Hear Audio ("Service"), operated by Happy Hear Audio. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Happy Hear Audio provides a platform for photo booth operators to upload, process, and share audio guestbook recordings with their clients. Features include audio noise reduction, AI transcription, emotion tagging, branded galleries, and analytics.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. By using the Service, you represent that you meet these requirements. The Service is intended for business use by photo booth operators and event professionals.

3. Your Account

You are responsible for maintaining the security of your account credentials. You may not share your account with others or use another person's account. Notify us immediately at hello@happyhearaudio.com if you suspect unauthorized access.

4. Acceptable Use

You agree not to use the Service to:

  • Upload content you do not have the right to use
  • Upload illegal, harmful, or obscene content
  • Upload recordings without the consent of the individuals recorded
  • Circumvent any security or access controls
  • Reverse-engineer, copy, or resell any part of the Service
  • Use the Service for any unlawful purpose

5. Virtual Phone, Call-In & SMS Messaging

Service Description: Happy Hear Audio provides a virtual phone number feature that allows event guests to call in and leave voicemail messages or send text (SMS) messages to an event guestbook. Operators activate the virtual phone for their events and share the phone number and event code with their guests.

SMS Messaging Consent & Opt-In: By texting an event code to a Happy Hear Audio phone number, you (the guest) are opting in to receive SMS messages from Happy Hear Audio related to that specific event. Consent is implied when you initiate contact by sending a text message to the event phone number. You will receive a maximum of 2 automated replies per interaction: a confirmation message and a thank-you message after your guestbook entry is saved.

Opt-Out: You may opt out of receiving SMS messages at any time by texting STOP to the event phone number. After opting out, you will receive a single confirmation that you have been unsubscribed. You will not receive further messages unless you initiate contact again by texting a new event code.

Help: Text HELP to the event phone number for assistance. You will receive a reply with contact information: hello@happyhearaudio.com.

Message Frequency: A maximum of 2 messages per interaction. No recurring or marketing messages are sent.

Message & Data Rates: Standard message and data rates from your mobile carrier may apply. Happy Hear Audio does not charge any fees for sending or receiving text messages.

Privacy: Guest phone numbers are partially masked (only the last 4 digits are stored) and are never shared with third parties, sold, or used for marketing purposes. See our Privacy Policy for details on how we handle personal information.

Supported Carriers: Messages are sent via Twilio and are compatible with all major US carriers including AT&T, T-Mobile, Verizon, and Sprint.

Call-In Recordings: When guests call the virtual phone number and leave a voicemail, the recording is saved to the event guestbook gallery. By leaving a voicemail, guests consent to their message being recorded and shared with the event operator via the gallery.

6. Your Content

You retain full ownership of all audio files, images, and other content you upload ("Your Content"). By uploading content, you grant Happy Hear Audio a limited, non-exclusive license to store, process, and display Your Content solely to provide the Service to you.

You represent that You have obtained all necessary consents from individuals whose voices appear in uploaded recordings.

We do not use Your Content to train AI models. Audio files are processed ephemerally by third-party AI providers and are not retained beyond the processing request.

6. Payments & Subscriptions

Per-event: A one-time payment of $29 grants access to all features for a single event. This purchase is non-refundable once audio processing has begun.

Monthly Unlimited: $49/month grants unlimited events. Billed monthly. Cancel anytime — your subscription remains active until the end of the current billing period.

All payments are processed by Stripe. Prices are in USD and exclude applicable taxes.

6a. California Automatic Renewal Disclosure

If you are a California resident, the following applies under the California Automatic Renewal Law (Business & Professions Code § 17600 et seq.):

  • Monthly Unlimited ($49/month) — your subscription will automatically renew each month at the same price until you cancel. You will be charged to your payment method on file on the same day each month.
  • How to cancel: You may cancel at any time by visiting your Account Settings and clicking "Cancel Subscription." Cancellation takes effect at the end of the current billing period. This online cancellation process is available 24/7 and is as easy as the original subscription sign-up.
  • You will receive a confirmation email after subscribing that includes the recurring charge amount and instructions for how to cancel.

7. Refunds

See our Refund Policy for full details. In general, we offer refunds for monthly subscriptions cancelled within 48 hours of charge, provided no audio processing has been performed. Per-event purchases are non-refundable once processing has started.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. We reserve the right to perform maintenance, update features, or modify the Service at any time. We will provide reasonable notice for significant changes.

9. Intellectual Property

Happy Hear Audio retains all rights to the platform, software, branding, and features of the Service. Nothing in these Terms transfers any ownership of Happy Hear Audio's intellectual property to you.

10. Termination

You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or are inactive for an extended period. Upon termination, your data will be deleted within 30 days.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not warrant that AI-generated transcriptions or emotion tags will be error-free.

12. Limitation of Liability

To the fullest extent permitted by law, Happy Hear Audio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Happy Hear Audio from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your use of the Service, or your Content.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.

15. Changes to Terms

We may update these Terms at any time. We will notify you by email or in-app notice for material changes. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
